On December 15, 2022, at the invitation of Shanghai University of Technology, Dr. Leslie Xu launched an online lecture entitled "Basic Trademark Theory and Trademark Protection Practice" to share knowledge and practical experience in trademark cases with students of Shanghai University of Technology.
Dr. Xu's lecture is mainly divided into two parts: the basic theory of trademark law and the practice of trademark protection lawyers. He first took Chang Tsi & Partners as an example to introduce the working mode, business structure and legal practice of an intellectual property law firms, so that students can have a more intuitive understanding of intellectual property lawyers and law firms.
In terms of basic trademark law theories, Dr. Xu explained the constituent elements of the trademark, the function of the trademark, the registration application process, the examination and approval, etc. in combination with the laws and cases. He shared his previous experience of receiving training in EU and German trademark law in Germany, providing students with a variety of learning perspectives. When teaching the content of trademark registration application, he analyzed the problem of malicious trademark squatting in combination with the hot spots of the World Cup, and especially shared his recent research achievements on freedom of expression in trademark registration in combination with domestic and foreign cases.
Regarding trademark protection practice, Dr. Xu focused on the protection of foreign enterprises' trademarks in China, and gave a general lecture on the formulation of trademark confirmation strategy, the fixation of trademark infringement evidence, the judicial and administrative protection of trademarks, the conflict between trademark rights and trade names, etc. He shared some of Chang Tsi & Partners' cases to guide the students to think about the legal principles behind trademark protection practice.
