Representative Cases

  • Represented a U.S. adhesive brand by combining civil and criminal litigations to combat counterfeit sources, securing RMB 2,370,000 in total damages. Sued a distributor for trademark infringement, settled with defendant in the civil case, requested the defendant to pursue criminal liabilities against the upstream counterfeiter, Jiang X, who was sentenced to four years and six months. In the criminal case, settled with Jiang X, obtaining RMB 1,800,000 in compensation.
  • Represented a U.S. adhesive brand in taking criminal action against Wang XX for his trademark infringement, resulting in a three-year and three-month prison sentence. After a favorable first-instance judgment, settled with Wang, securing RMB 600,000 in compensation, significantly higher than the RMB 250,000 in sales.
  • Represented a U.S. kitchen equipment brand in taking criminal action against Gong XX for trademark infringement, and successfully persuaded the local PSB to confirm the existence of a crime based on a notary deed. After weighing the client's trademark rights basis, the facts of the case, and possible sentence, advised the client to negotiate a settlement at the PSB stage, resulting in RMB 400,000 in compensation.
  • Represented a U.S. Fortune 200 multinational industrial company in a civil trademark infringement lawsuit in China. Persuaded the court to affirm the trademark's popularity and the defendant's bad faith, securing RMB 500,000 in compensation. Successfully applied for property preservation, freezing the full amount in the defendant's bank account, ensuring enforcement.
  • Represented a U.S. shoe company in a civil lawsuit of copyright infringement and unfair competition (for packaging and decoration) in China, and successfully persuaded the court to affirm that the plaintiff's work as protected art and that the plaintiff's shoes as a unique decoration for a well-known product, awarding RMB 500,000 in compensation. The case was settled in second instance.
  • Represented a U.S. kitchen equipment brand in an administrative complaint and reconsideration against a company in Guangzhou for infringement of business name. After Huadu District AMR rejected the case on the basis that it was not a well-known trademark, supplemented the evidence of trademark popularity and highlighted the brand's popularity and influence in the local area, which finally made the Guangzhou AMR make a favorable administrative reconsideration decision and ordered the infringer to change the business name.
  • Filed dozens of UDRP complaints for clients, all of which obtained favorable decisions.
