12 China Departments Issued Action Plan for Foreign-Invested Enterprises’ Intellectual Property Protection

Recently (On September 8th,2017), the National Work Leading Group Office for Fighting Against IP Infringement and Counterfeiting Products, together with State Intellectual Property Office, Ministry of Public Security, Ministry of Agricultural, Ministry of Commerce, General Administration of Customs, State Administration for Industry & Commerce, State Administration of Press Publication, Radio, Film and Television, State Forestry Administration, State Post Bureau, the Supreme People’s Court and the Supreme People’s Procuratorate, totally 12 departments jointly issued the Action Plan for Foreign-Invested Enterprises’ Intellectual Property Protection. According to the action plan, the action includes below 11 tasks.

  1. Cracking down on illegal and criminal activities as infringing the trade secret (State Administration for Industry & Commerce and the Supreme People’s Court take responsibilities according to their respective duties);
  2. Cracking down on illegal activities of trademark infringement such as “trademark free-ride” (State Administration for Industry & Commerce leads this task and is responsible for it);
  3. Cracking down on illegal activities of patent infringement (State Intellectual Property Office leads this task and is responsible for it);
  4. Cracking down on illegal activities of copyright infringement such as internet piracy (State Administration of Press Publication, Radio, Film and Television, State Forestry Administration leads this task and is responsible for it) ;
  5. Cracking down on illegal activities of new plant varieties infringement (Ministry of Agricultural and State Forestry Administration take responsibilities according to their respective duties);
  6. Severely cracking down on the activities of exporting or importing products infringing IP rights (General Administration of Customs leads this task and is responsible for it);
  7. Strengthening the supervision on mailing (State Post Bureau leads this task and is responsible for it);
  8. Severely cracking down the crime of infringing and counterfeiting (Ministry of Public Security leads this task and is responsible for it);
  9. Strengthening the procuratorial supervision (the Supreme People’s Procuratorate leads this task and is responsible for it);
  10. Strengthening the Judicial adjudication (the Supreme People’s Court leads this task and is responsible for it);
  11. Strengthening the external publicity (Ministry of Commerce leads this task and is responsible for it).

Regarding the timeline, the mobilization of this action shall be conducted before September 10th, 2017; the organization and implementation of this action shall be conducted from September 2017 to December 2017; and the experience summary of this action shall be conducted on December 2017.

This action plan requires the strong organizational leadership, closely coordination and improvements on the efficiency of handling cases.
