We are thrilled to announce that our Hong Kong, Macau, and Taiwan Team successfully represented a luxury brand giant in securing well-known trademark recognition of its house mark through a cross-class opposition in Macau, achieving a significant milestone at the start of the Year of the Snake.
In this case, our Macau Team proactively conducted substantive Internet searches and database searches to collect evidence, including comparable competitors' trademark registrations in Macau and the client's own trademark registrations in foreign jurisdictions, so as to show the importance and necessity of advertising and business management for a cosmetic brand, i.e., the close association and the essential complementarity between Class 3 and Class 35. In addition, our Macau Team also assisted the client in actively collecting and submitting a large amount of evidence to show its company and group's and it's house brand's worldwide influence as well as substantial sales, marketing, and operations in the Macau market.
With the substantive efforts devoted to the case, despite a lack of earlier trademark registrations in the same international class where the opposed mark was filed, the opposition was perfectly won through Macau IPD’s successful recognition of the well-known status of our client’s house mark, the identification of the unfair competition of the opposed party therein, and the favorable grant of stricter cross-class protection against confusion. This major accomplishment not only strengthens the protection of the client’s marks in cross-class scenarios in Macau, but also well supports the client’s contentious trademark actions in other jurisdictions.
Once again, our Macau Team’s commitment to delivering top-tier intellectual property services and strategic solutions tailored to clients’ unique needs has been well demonstrated and proved. In the New Year 2025, our Macau Team is fully prepared to achieve even greater accomplishments with unwavering determination. Should you and your clients need any assistance in trademark matters in Macau, please feel free to Lihan Yang, the leader of our Hong Kong, Macau, and Taiwan Team.
