In order to implement the relevant requirements of the "Outline for Building an Intellectual Property Powerhouse (2021-2035)" and the "14th Five-Year Plan for Intellectual Property Public Services", the Capital Intellectual Property Service Industry Association recently formulated the group standard-"Intellectual Property Public Service Standard" (hereinafter referred to as the " Standard"). On November 9, 2023, the Beijing Intellectual Property Office held a Beijing Intellectual Property Public Service Work Conference, at which the Standard was officially released. The Conference was chaired by Liquan Zhou, deputy director of the Beijing Intellectual Property Office, and Dongqi Yang, director of the Beijing Intellectual Property Office, attended and delivered a speech.
The Standard emphasizes the importance of assistance on protecting intellectual property rights and pre-examination service and prioritized examination service. The Standard requires all units to provide assistance services based on the needs of the public and innovative entities for intellectual property rights protection, including consultation and guidance and assistance in solving difficult cases. At the same time, all units should also guide the public and innovative entities to make full use of the pre-examination service and prioritized examination service to shorten the patent examination cycle.
The release of the Standard marks a new phase in the development of Beijing's intellectual property public service. It aims to promote the standardization and regularization of public services in the capital of China.
During an executive meeting on November 3, 2023, the State Council, China's Cabinet, approved the Draft Implementation Rules of the Patent Law. As an important supporting regulation to ensure the implementation of the Patent Law, the revision of the Implementing Rules of the Patent Law has been highly anticipated since the fourth amendment of the Patent Law was passed. It has been three years since the China National Intellectual Property Administration (CNIPA) published the Proposals for Revisions to the Implementing Rules of the Patent Law (Draft for Comment) on November 27, 2020. With the approval of the Draft Implementation Rules at the State Council executive meeting, the formal version of the Implementation Rules of the Patent Law is expected to be officially released soon.
